The Länsstyrelsen, however, has denied a permanent building permit for Trädgården, citing noise complaints from neighbors among its reasons. Despite acknowledging the club's popularity, Sandra Larsson from Länsstyrelsen noted that it does not meet legal criteria for public benefit, specifically referencing the lack of facilities such as restrooms or kiosks as per planning laws. Trädgården's management, spearheaded by CEO Johan Wiklund, contests this, insisting the venue serves as a crucial cultural institution that promotes community engagement.

In response to the decision, Trädgården's leadership has launched their campaign, 'Bevara Trädgården', and received endorsements from artists, including Veronica Maggio and Petter. Currently, the club continues to operate under a temporary permit and is set to appeal the Länsstyrelsen’s ruling to the Mark- och miljödomstolen by August 21.
